I've had it with these SOB's that think they own the runs.

Is there some kinda law that states that there are to be no obstruction in herring runs?? These SOB's are funneling the run with chicken wire and cages. I've had it with the arguments and yelling matchs in the middle of the night. WTF These are NOT indains, more like can collectors trying to make a easy buck.

Tonight I ask the dude "is this a one man run" he's plays stupid. I could either flip out or flip out my cell phone.....I chose #2. I'm not kicking a$$ but I'm definantly takin names and handing them over. I've had it.

You will always have that element that will dify the law.

Sometimes it is best to call the enviromental police.

And if allot of this is happening at night maybe night fishing for herring should end.

We have a small herring run but it is completely illegal to take them by any means in the brook!!!!

Goose did you call the EPO's? Is it strickly a town run? Call the Warden? I can get ahold of the EPO's direct if you'd like.

you know where everyone congregates to do something rather anal .....via the net... anyway my point is we have enough members to have a s-b army of volenteers for a rip it outta the stream operation... i have a forty foot chain

My point proven about the uselessness of the environmental police. Take that any way you want it but when you need them, they can't be found!!! Leave a message??? And then what, they gonna call back, and if they do are they actually going to do something??? That is the reason there are so many scoff-laws in regards to fishing rules and regulations. There is no enforcement to the r and r's. No punishment either when they actually do respond! I have seen warnings given out for taking more stripers than allowed and they even let them keep the fish. My solution is to personally ride these SOB's and make them miserable! Use Bassmasters internet to post a description of their vehicle and such so other people can keep an eye out for these useless pieces of crap!

Good luck with that Goose, I feel your pain. This post is in no way against your valiant attempt to right the wrong, just my opinion of the situation. I used to try this route, calling the EP's but to no avail, and the violators know how lax the system is and that they can get away with it!:(

maybe look into the town conservation board.
if we can get these tree huggers to make the runs conservation land, then maybe the local police can enforce the law?

How about this: At a popular S. County run, a guy had a net with a tomato basket wired inside it so it would stay open. His friend would walk downstream and then herd the herring up the stream into his turned-around net. This tactic produced about a dozen fish per pull.

My son-in-law was there and told them that those fish probably hadn't spawned yet.

They told him to f*** off.

The EPO's budget probably does not provide for them to be answering calls from their home at night, in other words twenty-four hours a day. I'm not making any excuses for them or anyone in my field of employment related to mine who is ineffective, but lets face how many people here on this list go to work for nada?
That being said, if a law is being broken wherever you are, whether it has to do with seining herring in an unlawful manner or elvers for that matter call your local police departments. They work 24/7/365 days a year. What might happen when you call is that the person on the desk might say, "we do not enforce those laws," but they do. A state law is a state law is a state law. Any sworn law officer in the Commonwealth of Massachusetts can and has to enforce every law when called upon. Are they all trained in the law, no, but they all know how to look up each and every one of them and make a determination if in fact the complainant(you) was right when you called. What the officer really means is that they have little or no training in enforcing the laws as they pertain to herring, elvers, and the illegal taking of undersized stripers. What the caller should request at this juncture is a shift supervisor, then the onus for action or lack of is on the entire department or municipality, and for that supervisor when he arrives should take names to be summons to court at a later date after the supervisor researches and evaluates his options when he does look up the laws in regard to our concerns here on this list. In requesting a supervisor your placing that town on alert that your are going to follow up on the initial call when you requested the officer to begin with. ONE THING EVERYONE HAS TO BEWARE OF THIS WILL ALSO GENERATE A SUMMONS TO YOUR HOUSE BECAUSE YOU ARE THE WITNESS. THIS MEANS YOU WILL HAVE TO GO ON THE STAND AND BACKUP WHAT YOU SAW AND THAT YOU COMPLAINED ABOUT IT ENOUGH TO GENERATE THIS COURT ACTION AGAINST WHOMEVER WAS VIOLATING THE LAW. This is where it gets sticky. I have been a policeman for thirty years, and I dont go around letting everyone or anyone know this very often, I am here because I haven't met anyone on this list that I do not genuinely like. But when it comes time to go to court most people dont feel as strong about their original intentions as when it comes time to answer the question, Do you solemnly swear...................? And your reply is, "I do." Every action on you part in this regard will have a ripple effect.
If you have herring runs in the town you live in contact the local polce department and find out if they officers have been trained in these laws. Many of the laws are quite strong and allow for arrest, for offenses such as fishing without a license. I would strongly suggest that no one here takes any aggresive action streamside in the middle of the night. I dont know about anyone else here but with my luck that the putz I catch stealing the herring would be armed with a .44 nickel plated bulldog. CALL THE LOCAL POLICE WHEREVER YOU ARE. IF THEY ARE NOT TRAINED IN THE LAW THEN DEMAND THEY AT LEAST TAKE NAMES AND CONFISCATE THEIR EQUIPMENT FOR EVIDENTIARY PURPOSES. DONT WORRY ABOUT HURTING THE LOCAL OFFICERS FEELING WE GET PAID FOR THAT TO OCCUR. EVEN IF THE LOCALS DO NOT SUMMONS THE PERPS TO COURT AT LEAST IF THE LOCAL OFFICER LOGS THOSE NAMES THEY CAN BE TURNED OVER TO AN EPO DURING DAYTIME BUSINESS HOURS.

Let's just say #^&#^&#^&#^& is the guy with the chicken wire, and Fred is the guy with the hand net. Fred approaches the run at 2am and #^&#^&#^&#^& is already there. Fred is mad that #^&#^&#^&#^& has blocked off a part of the run. Fred calls the police. The police arrive and Fred insists that #^&#^&#^&#^& is breaking some "Herring Run" laws and wants #^&#^&#^&#^& punished. The police confiscate #^&#^&#^&#^&'s equipment and fine him.
Fred proceeds to catch his limit of herring. Not far from the run, Fred uses the herring to fish with. The fishing is incredible!! Fred goes through his limit of herring in no time at all. Fred then hurries back to the run for more herring. Is there a difference? Both are breaking the law. I'm knit-picking? The facts are the facts. I won't call the police on a person who breaks the same law that I do. If I'm having a great night of fishing live herring, and I run out...you bet your a$$ I'm going back for more herring...and if you guys wouldn't....:rolleyes: ...go tell another fish story.

They think... "Herring run violations?!......ho-hum, Don't waste our time.... CWOF, next case!" And next time, we'll really get mad!!!

We both know, in this liberal state of ours, many, many get off for FAR worse things than poaching our natural reesources.:rolleyes:

Fred can make money off the run and I can only use it for bait, and thats if hes not there cause he usually is.

Yes I live in a glass house..... plexy glass. We know I'm no saint and I've paid my due's and learned from them, I'm better then I was.

My feelings on 'herring' runs are as follows:

I do not believe a recreational fisherman like myself can damage the herring stocks. Multiply the number of herring that I use for bait in 1 season by 2,000 fisherman and it still doesn't compare to 1 commercial herring vessel.
My herring season is a short one, so if I'm having a great night...I'm going back for more. If #^&#^&#^&#^& is there with a chicken fence blocking their path ;) I'll find a way to get some...like I always do. Can #^&#^&#^&#^& stop me from blocking his path? Can #^&#^&#^&#^& stop me from walking up and down the run not allowing the herring to even reach his fence? If I get into a bittchhing match with #^&#^&#^&#^&, all I'm doing is wasting my time, time that I could be using to fish. All I know, is.. if there are herring in that run...I'll get what I need or at least try my hardest to...and NO, you don't live in a plexy-glass house...as a matter of fact, you have a beautiful house and your a fisherman that I respect highly. I'VE SEEN YOUR DEDICATION FIRSTHAND, I SEE YOUR HARD WORK, YOU WORK VERY HARD FOR EVERY FISH YOU CATCH....I CAN, AND WILL VOUCH FOR YOU ANYTIME. My first line, about the glass house was NOT directed at you, it was a general statement. I read alot of posts on here that I feel are bull#^&#^&#^&#^&, so before people hopped on the bus...I gave it a flat tire. I know your a law-abiding citizen and I respect you for that. You were there with me and the Tattoo'd freak digging out a herring run, and I'm not talking sand here....WE KNOW THE HARD WORK WE PUT INTO IT. I just couldn't comfortably call the DEM on a person taking herring illegally when I know I could possilby be guilty myself. Does it make it right? NO...it's just my opinion.

Say, not to change the subject, but do either of you young fellas know where an old guy who doesn't talk too much might find an eel run? You know, not too long a walk - I don't get around so good these days, it's an old trout injury - but I wouldn't mind just a coupla eels for when the big girls come around.

Boy, I'll tell ya, those big bass do like a fresh eel - for chrissakes, old man Clarke useta keep a bath-tub full of 'em in his basement all the time. Now there was a guy that knew eels - ahhh, you younger guys today probably wouldn't know him anyway.

But eels? Hell, I knew a fella claimed he kept 'em in his toilet tank so's the missus wouldn't see 'em. They'll live just about anywhere - of course, I wouldn't kiss one for luck if I knew somebody had kept it in the crapper.

So, whaddya say - how about helping an old fella out here...that's a helluva tattoo ya got there......lemme show ya mine, I don't often do this........:bshake:

Two different "herrings" the ones in the runs are really alewives, the ones the herring boats catch are sea herring. No relation to each other, just the names cause confusion.
