I went to a spot earlier in the year that at a remote point of it, there was a area cordoned off for plovers...

It was a big peninsula and in the middle of it, it was cordoned off. basically the entire interior of it. There was an area around who who exterior that was not. The cordoned off area was about 10 yards higher than the tide line.

Are those areas still considered off limits even if you are on the waters edge?

With the MSBA tourney coming up, its a place I would like to go out to again, but want to make sure I am not gonna have a big fat fine or worse waiting for me.

My experience with any cordoned areas is that they are ALL above the high tide mark (birds don't nest below that line for obvious reasons). I fish a lot along the general "Race Point area" and the bird nesting zones are always well above the high tide mark.

At minimum you can drive those areas at half-tide down to low. I'm not sure what area you're talking about, but where I fish, the bird nesting zones are clearly market and roped off.

Bottom line: If you are below the high tide mark, you should be cool.

sounds kooky

I do think there is an alternative policy that could be implemented, and at the same time bring positive public relations to the US Fish and Wildlife Service. It is to issue beach walking licenses to anyone interested in wildlife. To obtain a license, you would take an exam proving that you can identify endangered species and plants, and then sign a pledge that you would stay near the high tide line, and not disturb any nesting birds. If this appeals to you, write your Congressman.
