Guys just a warning to those buying Hab's on ebay. The seller with the following two auctions have stolen photos and text from my listings last week. I have contacted ebay but do not want to see one of you guys lose money on this.

Don't fully understand your gripe. If this seller is selling the same product who cares where he gets his photos or a bit of text. As long as it is new in the bag. Did you take this photo yourself. You could have got it elsewhere too?:huh:

I dont have a gripe with him if he has the product but does he have the item. Why not take his own photos. My photos are stolen all the time and then used to sell items that the person does not actually have.
My problem with this is somebody winning the item and then getting beat out of money when the guy dont have the item because he used my photos.
I am just trying to look out for you guys. That is all.

Beamie, are you selling the needles? :hihi: I think Dave was just telling us to look out and that it may seem suspicious to not use you own photos for an auction when the Hab's lures are so coveted right now. Perhaps it was just easier and they may be EXACTLY the same lures, Dave just brought forward the fact that the photos were taking by him for HIS auction..... Just looking out for us thats all. Who wants to pay $75 bucks for a needle and not even get the one they thought they were getting? Thanks Dave,

Man, is this Hab plug selling out of control. I just went and looked at EBay and see Hab plugs being bid on with prices like $70, $80, $90 dollars.

I should be rich. John gave me hundreds of plugs to field test back in 91 and 92 before he hit the market commercially. I, in turn, gave lots of them away to friends.

Still got a stash but not what I had.:humpty:

First, it's against ebay rules to copy photos and/or description. If you scroll to the bottom of any auction page there is a "Report this item" button and you can choose that particular issue to report. Second, it is almost always an indication that the auction is a scam. No matter, no-one wants another seller to use their description and photos to sell an item and ebay does not allow it.

Did you report it through the button at the bottom of the auction page giving ebay your auction number and the two copies? They usually are pretty good at dealing with this stuff. Whenever something becomes valuable and collectible it happens and often involves hijacked ebay accounts as well. I deal in high end vintage trumpets and see it all the time... often from stolen accounts or off-shore sellers.

Seems like a good time to sell. No reason not to take advantage right now. It looks like there should be up to 250-300 pieces ready for the RISAA show.

If the seller doesn't have this exact product then yes he is a scum and I thank Dave for posting this so people are aware and don't get scammed, but no one knows that yet.

If he does have it then I still don't see the problem. OK maybe it is against ebay policy. Maybe he doesn't have a camera.

right off the manufacturers sight. Same same.

Both scenarios are copyright infringement. You could even Photoshop an image and it's STILL copyright infringement, "derivative use" is also unacceptable.

Copyright is implicit. You don't need watermarks or to have "Copyright" stated at the bottom of the page.

I only watermark SWE images these days to make it easier to stop people from using them. When I contact the thief and the image they are using has our watermarks it comes down promptly. When they weren't watermarked they often give me the "oh, our web guy isn't in today, we'll get to it as soon as we can".

You'd be surprised how broad copyright protection really is.

I stand corrected if what you say is true. To me it just doesn't seem to be a big deal as some people think, it is just a picture.

So your saying everyone on Ebay that is selling a NIB fishing reel using a stock catalog photo and description is technically wrong and against the rules/law?

They may not get prosecuted, but yes. Unless they have permission to use a company's media tools (most dealers do).

I know most people view a picture as "just a picture", but we've (The SWE) spent many, MANY $$ and hours creating quality images (as did someone somewhere in the case of any quality image) for our website. The computers we work on, the software, and paying the people to do the work, etc. It's an investment we make to help differentiate ourselves from others and it costs serious time and money. And then a competitor takes the image for free and sells the same product on our dollar and time? The image issue strikes close to home for me because we have had a lot of issues with it.

I think its fair enough to warn people that the item pictured is not the exact item being sold. It may be identical but if the picture was taken from someone elses website , the article is not the exact article pictured. i would want to know that.

Good point on the cost of taking a quality picture especially if you can't do it yourself. You are totally right.

Though I do think that there is a big difference between a nice photo in focus at the beach next to a slob in good light and something sitting in a bag on a bench.

I could only imagine the time you guys spend on photos. IMO, they are the best I've seen for fishing tackle. Very well done!!!
