That was a horrible thing to happen to an up and coming young 22 year old ball player and 2 others. I heard it the next morning on the news and it was very sad, even worse it was caused by a drunk driver going thru a red light :hs: I think the guy should be punished to the fullest extent of the law as well as other convicted drunk drivers, but now on the news they are saying he is being charged with murder. Wow, I thought the definition of murder was killing with a purpose, I thought drunk drivers don't kill people on purpose. I guess they have raised the bar and are showing how serious drunk driving is. I wonder if this is setting some kind of precedent.

I thought this was interesting as well so I looked it up.
You can get charged with murder for a DUI death if they feel you have an understanding of your actions and show a conscious disregard for the safety of others. In this case the man was an habitual offender so he was well aware of his problem.
It's certainly a valid argument to say that he has a disease etc... but that doesn't mean you're not conscious of your actions. Even a drunk knows when they're sober that they're going to get lit.
Very sad story though.

he was driving on a suspended license and it was suspended for getting a dui on a previous occasion.
3 times the legal limit of alcohol...
a 22 year old goes to heaven just as he's becoming a super pitcher
and the 20 yr old dumbazz goes to jail for life.... such a waste
to bad he wasn't just smoking.

i think his fleeing the scene led them to the conclusion that he was aware of what happened, well aware enough to know he needed to GTFO out of there or he was screwed, so they charged murder
