I find the fact that they claim 600,000 herring entered his bog to be entirely inaccurate and impossible. I love how they trump up these numbers! 2,000 does sound more accurate but I am not trying to diminish the seriousness of what he did.

That's a $10,000.00 net "malfunction".

That's to make up for the lack of accountability of the netters' bycatch/kill. They have to make up for those numbers somewhere.
If it wasn't this guy, they'd claim the storm killed a half million, and wouldn't have to prove a thing.

I agree, 2000 sounds more likely, and exactly WHEN did they discover this? Was it after one of our recent storms? Could the net malfunction be attributed to the "forces of nature"?

If this occurred months ago, it doesn't instill a sense of reliability if it takes 2-3 months to have this come to light. It instills a sense of neglegence or incompetence on the part of the authorities that are just now reporting the incident. Maybe they needed more time to find a way to trump up the charges?

Here the first story... (http://www.allbusiness.com/legal/trial-procedure-fines-penalties/15217303-1.html)

I believe the story of 500-600k of juvenal herring. ... not inaccurate or impossible.

Females lay 60-100k eggs.

I seriously doubt a peep would have been said for 2,000 juvie herring.. think about it for a minute.. we are talking about 1.5-3" with 2.25" being average juvies here...

"Jeff LaFleur, executive director of the Cape Cod Cranberry Growers' Association, sent one of his staff members to Handy's bog Wednesday and said he also disputes Martinsen's numbers.

"My staff said there's no way the number of fish was that high," LaFleur said. "That would be about 14 tractor-trailer trucks worth of herring. Something is way off here."

But Martinsen stuck to his estimates and said the herring were swimming throughout the entire bog and a number of them were caught in the sluiceway prior to draining the bog.

He said natural resources officials manned the area all day Tuesday and overnight Wednesday while the bog was being drained and herring were dropping back into Wing Pond the entire time."

This guy has water rights and/or manages water resources that impact quite a few herring runs on the cape.........

It was well covered in the cape papers when it occurred.
It is not the first time he has done it.
He has had all sorts of fights with the town re: the town bogs he operates. The town has decided they want these bogs to be farmed.
No one else has any interest in operating the bogs, so the town has to put up with him and he knows it.

Well if i had one Herring in my possesion on the cape and DEM found it they wouldn't stop till they had my truck and gear. Those are their word to be exact. So I really don't have a lot of sympathy for someone in his shoes as with all the permits and such he deals with he knows what he is supposed to do along with the whys and whens.

Go to new Bedford and see how many river herring are being sold as Atlantic sea herring.
