we were at dux beach this morning and around 8:30 were asked to leave because the parking lots were about to open. i could understand if there were people swimming but there were only a few people walking the beach and we were in no ones way - plus we were catching. i didn't put up a stink this time but do they have the right to make me leave?

if the beach has a life guard assigned to it then yes, there should have been posted signs stating this.

There are signs unfortunately, no fishing when beach is open. Plenty of people lining up to pay 15.00 to park and use the yuppie beach. Makai is dead on, elitest snobs.

Everything is just so wrong about this. Make us buy a license and then deny access. Makes me sick.

It looks like about two thirds of the beach is owned by a charitable organization and actually leased back to the Town of Duxbury for use by the public.

Considering this, one would assume the town has a business interest in generating beach traffic that will benefit local business and help fund the lease. This interest would certainly be hampered if sunbathers and swimmers had to contend with people fishing.

So while it may kind of suck, it doesn't seem like this is a grand conspiracy against fishing.

Or, think of it this way...the taxpayers just funded you to fish on a mostly private beach until 8:30am :hihi:

I remember years ago up at Plum Island signs were posted that fishing was prohibited when lifeguards were on duty. One young lifeguard told us we would have to stop fishing, but quickly said "nevermind" when he looked up and down the beach and realized that besides him, everyone on the beach was wearing waders.

There was a state beach where fishing on one night was stopped. Reason given was that there was concern for bathers due to the potential for lost or broken off hooks.

There is no fishing on the public beach between certain hours and it is still left to the discretion of the lifeguards. The town can't afford lifeguards so there are none. LMAO! So a cop would actually have to drive, park and walk down to the beach in his shiny black shoes and ask you to stop but he can't ask you to leave.
Whatever happened to that law that says we have the right to fish below the high water mark as long as we do not cross private property to do it? Also if you pay to park in that lot what difference does it make to them?

If city or town owns or leases the beach or public way you should partition the city or town councilors/selectmen to have a portion of the beach open to fishing. At one time they tried to close what is known as the bolavard from fishing and many people walk this area along the water. No one has ever been hooked or injured from anybody casting. It was never closed to fishing.

we moved a few a few beaches north today. no one asked us to leave here, except the fish - cause we were catching so many :). happy 4th everyone
