The reason the feds get $150 is not because of us fishermen. it's all the nitwits that want to prove their 4 x 4 can go in the sand.
The last time I fished the Cape was in Aug of 2003. One Thursday afternoon at 2:00 PM there were bumper to bumper trucks from the beginning of the Back to the Mission Bell. Grills, sun tents (*or whatever you call them cabana things), float tubes, tables and chairs, etc. etc. Back when the Back Beach was "good" you could drive all day and all night and maybe see 3 or 4 other trucks and you knew the guys in them. with todays technology there should be cameras posted on many nests so they can determine exactly what fate those nests endure. habbitat can be created! and not just preserved elsewhere without ever infringing on the rights of fishermen and beach access . it's nothing but a friggan excuse. Just like my neighbors were trying to find some rare species of something to stop a housing developement from going in...but it didnt hold water in the end.they lost. |
Here's what you're up against.
Go to a law school's library, or to the Federal courthouse's law library, and look for a collection of maroon books titled USCA--that's "United States Code Annotated". Those books contain every Federal statute passed by Congress. It should take up at best one row of shelves. Next, look for larger brown bound books with a red band across them marked CFR. Those contain the various Federal regulations enacted by a host of regulatory agencies--after the proposed reg has been published in some arcane directory for "public comment". Compare the vast space they occupy compared to the much smaller space taken up by the volumes of USCA. Next to them will be identical looking books called the "Federal Rules Decisions", or FRDs. They contain the court cases interpreting those regulations. They take up almost as much space as the Federal Reporter and the Federal Supplement, which report Federal court decisions in litigation. Laws are enacted by legislators who are, at least in theory, accountable to the voters (altho when we mindlessly re-elect over 90% of the incumbents in the House and Senate every 2 or 6 years, that accountability tends to disappear). Regulations are enacted by unelected officials who are accountable to....???? I don't know how long it's been since Honest Abe's government "of, by and for" died, but it's been a spell :humpty: |

From what Karl has told me it seems like an uphill battle to fight those bird/nature groups. Once they get off the endangered list maybe things will get easier but I doubt that since they will just manipulate the numbers most likely :rollem:
here is the reply I got by email Vehicle access to the Seashore's beaches has been temporarily closed to protect piping plovers. Plover management at the Seashore follows the guidelines developed by the US Fish and Wildlife Service and the Piping Plover Recovery Team in 1996. These guidelines call for vehicle-free areas to extend at least 200 meters on each side of a plover nest for the first week after hatching, and after a week, at least 100 meters around the brood until the chicks fledge. In some instances, based on the behavior of the chicks, the buffer may need to be expanded. Vehicle access was closed at the Race Point North and Race Point South accesses earlier this month when nearby nests hatched. This past weekend, nests adjacent to the remaining vehicle access routes along the Pole Line Road hatched, closing these access points to vehicles until the chicks fledge or move out of the area. Vehicle closures on portions of the beach occur every year, but this is the first time all vehicle access has been closed. These closures are temporary, and will last only until plover broods fledge or when trained staff observe the brood a safe distance from vehicle access points for a period of time and don’t expect the brood to return. During the negotiated rulemaking that formed the basis of the park's oversands vehicle program, the parties involved agreed to avoid adversely affecting plovers by adopting the recovery plan guidelines. When we became aware of the likelihood of a complete vehicle closure, we asked for help from the US Fish and Wildlife Service to see if there was another approach that would provide some kind of vehicle access while meeting the negotiated rule's plover protection objectives. Despite our best combined efforts, no other option was available to us to get vehicles on the beach without substantial risk of direct harm to plover chicks. We deeply appreciate everyone's patience, and we assure you that vehicle access will be restored as soon as it is possible to do so without harming the plovers. We have a legal responsibility for piping plover management and we have an obligation with the Off-Road Vehicle Community. We work very hard to accommodate access when we are able, and have to make hard decisions on closures only when required. We apologize to those who must change their plans, but hope everyone can understand the long-term benefits of this action. Current oversand corridor information is available 24-hours a day on a prerecorded message line and can be accessed by calling 508-487-3698. Like they care that the vacation you bid and can't change months ago is out the window...all the preparation, investment, and hopes to have a decent family vacation are stuffed... Gee every year it closes earlier and for longer, hmmm these birds really seem to be struggling... Then when more of us give up the permits, they'll say; "Our studies indicate that there is a reduced demand for oversand vehicular access, therefore we propose to make the CCNS a bird sanctuary. If you want to go see the beach, join Mass Audabon, then pony up a daily fee to observe the guided tour from the misguided idiots that took the National Seashore away from us. I think I'll go into another sport with a brighter future, maybe hunting Buffalo on the open plains...what a crock of ...:bshake: BTW have fun with your campers in the parking lots,MBBA and others who sold out to get the tin condos on the beach as a trade for miles of the most productive surf on the planet being padlocked....

Krispy, That was the other "Back Beach", I'm backbeach- my mistake- I registered before checking out names on the site and the software didn't kick it out when I put it in as one word smallcase...I contacted the other one and we have known each other for years, but both have been put off by the BS cming out of the CCNS... I feel the same about the name as he does though...one of many things we agree upon. Thanks for the picture of me at the Canal, I'm glad you got my good side:thanks: What we have lost at the beach has been like a death in the family. I used to go down there as a sanctuary from lifes troubles- I used to feel I left all the bad stuff on the mainland side of the Canal... Now going down there brings more hassles than anything. I never would have bought a bigger boat than my tin "backbeach sled" if we could really still fish the beach. When you fish from a boat you can't relax as much as you can in the surf- ur constantly on lookout for hazards. In the surf- you can concentrate on the fishing. To drive a couple of hours to get there, and leave a bunch of tackle in the truck in a lot is nerve racking. So now you decide on one, maybe two sticks and a bag of plugs- and hope your plan doesn't go out the window when it blows up to 30+ and all you can do is sling 8oz and sandeels...or it goes flat and all there are is schoolies and you have the meatstick rigged eel rod. Wow, what fun! I'm sure the powers that be down there look at us more as vagrants than tourists- since we aren't going out for $100.00 meals or renting B&B's since we fish all night anyway...I wish I had more hope, but it just keeps getting worse.
