Thats what I mean. JohnR isn't making a profit off of showing this movie. A fishing documentary is alot different than a hollywood movie also. People want to have this movie for themselves so that they are able to watch it whenever to get pumped up for the season or refresh their memory on a certain lesson. As of now I have not purchased the movie but have every intention to purchase the movie regardless of wether or not it is shown at the meeting.

He may not "make a profit" but he may draw more people to the event with the announced showing of it, thus costing the producer. Is this not true? |
Copyright
Not for nothing, and I dont disagree with Fisheye, but I have a question as far as copyright infringment is concerned. You cant lend a CD, or copy one, you cant have a few people or fifty over to watch a movie and/ or copy it, but libraries can lend books with copyrights attached to them. You can copy any part of the book you want for future reference or resuse (researching school work). You can also get CD's (music and video) without charge, from the library, how is that different?

TT is right, and the law applies to public viewings, not private.

Copyright issues aside for a moment Mike offered several days ago to put together some video should we choose to accept for TFCTFN. He will be doing a show on that tentative (for us) weekend otherwise he offered to show up and bring some schtuff for us.
Now I'm not exactly a lawyer but I would assume that the whole "copyright" doohickey is imaterial in any case should the publisher (which I assume is Laptew Productions) gave permission for us to use it. I also think it would be a captive audience infomercial almost in getting people to chose to purchase the DVD. But as much as I am not a lawyer I am also not a marketing wunderkind either. So any of that would be up to Mike. I also think that he was nice to offer other video should we choose that route.... |

Anyway, the law is clear on this... ===================================== The public performance right allows the copyright holder to control the public performance of certain copyrighted works. The scope of the performance right is limited to the following types of works: literary works, musical works, dramatic works, choreographic works, pantomimes, motion pictures, and audio visual works. Under the public performance right, a copyright holder is allowed to control when the work is performed "publicly." A performance is considered "public" when the work is performed in a "place open to the public or at a place where a substantial number of persons outside of a normal circle of a family and its social acquaintances are gathered." A performance is also considered to be public if it is transmitted to multiple locations, such as through television and radio. Thus, it would be a violation of the public performance right in a motion picture to rent a video and to show it in a public park or theater without obtaining a license from the copyright holder. In contrast, the performance of the video on a home TV where friends and family are gathered would not be considered a "public" performance and would not be prohibited under the Copyright Act. When is (tenatively) March 3rd at 7 pm at VFW Fairhaven. That is, of course, if the Dons get the hall at the last minute, and save the party (like they always do). Donations will be accepted in the big black Avalanche in the back. |

As I understand it, it is fine for clubs to have a library with videos for their members to take home and watch with their friends and families. I think the rub comes with mass viewings, especially when folks pay to watch it. At least that's how I read it. Hi John. Actually I tend to lurk here mostly during those times that I need a break from the fisheries stuff. That is to say that I find more "actual fishing" stuff here with a more local flavor (for me) than most other sites. TCFF is not far for me. I'll try to make it again. I really did enjoy that classic slide show the last time I went (sweet audio system too). If you showed that again, I'd be fine. But I'm sure whatever you come up with will be worth it (if not for the food too) :humpty:  Best, Mike F. |
I never thought that simply stating my intellectual property rights would create such turmoil.
The fact that this is an occupation for me and not a hobby should be considered. I’m also in the business of doing seminars for a fee and I don’t want large fishing clubs around the country playing my DVD to 50 or 100 members as apposed to having a guest speaker. It’s not fair to me and it’s not even fair to other talented outdoor writers and speakers that might lose an opportunity for a show. Some folks argue that a public viewing is advertisement, but I don’t feel that it’s good advertisement…if you’re trying to sell milk, why give away the cow? Movie trailers are 30 to 60 seconds, not 30, 60 or 90 minutes. I’ve supported S-B.com in the past with two video presentations at the annual winter get together and I’ve offered to do the same this year. If the event goes off on March 3 when I’m doing a show in NY than I’ll be happy to provide a DVD with loads of footage, in fact I’ll offer 90 minutesof content from some of the more popular shows I’ve done in the past, coupled with new material from this years show. If anyone has seen SGW you might have noticed that I advertise this site as a great place to visit…because it’s so friendly. |
I'm sorry, I didn't mean to open this can of worms. I kind of just assumed Mike would be there as in past years. His presentation was awesome a few years back, and I for one would be psyched to see anything he has to put together for us. Thanks in advance Mike!
