As far as the "with complete safety" on the retreat goes... what do you suppose the scenario is if you are on the bubble weed covered rocks of the canal at low tide... by the time i found my footing up the canal to run, i could be dead six times. Maybe more depending how fast they can reload.

The bottom line is, self-defense comes down to a question of fact for the judge or jury. All aspects of it. And Barnstable County is still a place where the average juror would be more inclined to side with the respectable citizen, with a clean record, over a guy with a record as long as the canal who approached a fisherman minding his own business. Regardless of the nuances of the law, and the instructions from the judge, jury nullification happens, and it happens most often in cases where punk confronts citizen, and citizen lays out punk.

The other thing to keep in mind on the Canal is this---you'd be dealing with the Bourne or Sandwich PD, and they also would be more inclined to side with you over a well-known local POS. You have to get charged first, to be prosecuted. ;)

in a word...YES. if someone threatens my well being and wants me to hand over my hard earned posessions and i have the means to safely (as in mine) defend myself- i would using anything at my disposal. 60# boga, dive knive, 4/0 vmc, and other means depending which state i'm fishing in. just saying...

My point was about dealing with unarmed people trying to take your stuff from you. If they're armed, I agree with doing what you have to do.

BTW, I've seen that rod you fish at the canal. If you can keep them at rods length, you'll have no issues with them getting close enough to you to do anything

Here's something for you all to think about. I've worked in a prison for 27 yrs. it's only gonna get worse. the do goodders are now working harder to give the scumbags more excuses to justify victimising law abiding people and ways to make us worse than the scumbags.Just remember a dead scumbag can't testify.Just make sure the do gooders don't see it happen.You'll get blamed for protecting yourself.
