Plus, how do you “defy” a decision which says states can decide what to do?

Plus, if she can defy federal
law, does that mean I can defy the Internal Revenue Service? Because if I can do what she says she’s gonna do, then there’s a 26 foot Regulator with my name on it.

When the Supreme Court acts like a legislative body overturning established precedent that they lawyerly failed to tell the truth about in their confirmation hearings they are viewed correctly as a political body.
Not one elected or wanted by the majority of voters.
Unpopular legislation doesn’t work.
Just wait for what the ultra right wing Court does next, because in a concurring opinion overturning Roe, Justice Thomas said that SCOTUS should reconsider opinions protecting same-sex relationships, marriage equality and contraceptives.

The court must "'correct the error' established in those precedents," Thomas said.

The only saving grace about Justice Thomas's concurrence is that no other justice joined it. At least, not today.

So now for good cause American confidence in Supreme Court sinks to lowest level ever recorded by Gallup

Jim tell me this , So every SCJ since the the 72 decision. All of the SC Justices who came before the current 3 newest were complete idiots and wrongly interpreted the constitution.. ya ok .,, this ruling wasn’t about the law it was about the lord

Exactly. Roe may have been a flawed argument, but it was challenged how many times during Reagan’s term alone? That eventually culminated in Casey.

So basically, the Fox News 5 + Roberts decided this time was different. Of course three of them (maybe more) distinctly said during confirmation that’s Roe was settled law at this point.

Everyone should read Supreme Myth’s by Segal. It predates all the recent stuff by a few years but shows some of the history of the court acting as a political body (on both sides).

Viability, which obviously changes all the time.
I am not saying this is easy. Put a cap on it, 20 weeks, whatever seems reasonable and don’t remove exceptions for rape/incest/life of mother.

you responded straight up, i respect that. that is sincere, not sarcastic.

i’m a math guy. things need to make sense to me. my issue with picking a point, say 20 weeks, is this…the baby is no different on the last day of the 19th week, than it is on the first day of the 20th week. i think there’s only one spectacular moment, one time when something gets created that didn’t exist before, that’s conception. But that’s my logic, and reasonable
people can disagree.

but we both seem to agree that women can choose to do whatever they want with their own bodies, as long as that choice doesn’t hurt someone else. you and i may disagree a little on what constitutes “someone else”, but we seem to agree on a big chunk of it.

And i’m fine with leaving exceptions for rape, incest, and the health of the mom. those are, thankfully, rare.

Stating the obvious: but so everyone is clear. It is absolutely the case that the very first legislative priority of a Republican trifecta at the national level will be a federal ban on abortions. It will be HR 1.

I hope the saying be careful what you wish for comes back to bite the far right. Women are coming out to vote and which side of that debate hold the bigger numbers. Time to add more justices to the Supreme Court to balance things out and I hope this administration has some foresight to see that’s required to properly represent the country as a whole.

was the court was left tilting since Earl Warren was on it. but that imbalance was ok.

you add more, then the right adds more when they’re in charge. where does that end?

do you binder stand what happens here? abortion will only be outlawed, i. states where people
want that. that’s how state governments work.

Is this why Pence announced he thinks abortions should be banned by federal law and he’s the guy to do it? Truth is any Republican running in 2024 will do the same to make abortion illegal everywhere in the US.

It’s going to the states where it belongs. WE get to decide, rather than 9 unelected judges. I can live with that, even though I know it means abortion will always be legal in many states.

It’s a political/legislative issue, it should be decided by us.
