home cheapo... ouch!
 
was in homies yesterday and injured by by falling stock from an overstocked shelf. store ass/mgr admitted (in writing) that shelf was overstocked. missed 1-1/2 days from work already(doctor said it will probably be more). homies said they would pay medical but not missed time, they say vendor who stocked shelf is liable and not them! they had attitude- big co., big 'tude. be careful in there!

i work for the other 'big-box';
get yourself a lawyer.
they have both been sued for "overstocking " top stock .
more than likley they will settle out of court ; if you are reasonable ...
don't take the stores additude ; ask for the district managers # &
the # of the home office . i bet a single phone call to either 1 would take care of it .
as far as it being the 'vendors ' fault the store is responsible for anything the vendors do .

Screw them. Sue Home Dirtpile and let them interplead the vendor and fight it out among themselves whose fault it was.

I agree. The sign on front says Home Depot not vendor. So they are responsible.

i know for a fact that one of the first things on the mod's list in the am is to walk the floor & check topstock; & it is done several times during the day ....
get them , they get sued all the time ......so do we

It is their store regardless of who put the stock up there, they are at fault....and if that is the case then you get a good lawyer and sue them both......more bucks for you! You have a case without a doubt....get a lawyer and go from there!;) Hope you are OK!

thanks for the input/info guys, i think you're right. gotta make some calls( anybody got jackie chiles #?). had a block is. trip planned for friday, hoping i can limp around boat ok.

I would'nt talk to them anymore. Hire a lawyer, and let them do the talking. Just stay away from the guys on tv.

wow! called 2 lawyers today (good ones) nobody thought since i wasn't mortaly wounded it was worth it. i have bruised bones on foot, real hard time walking, it really hurts. still not able to work.

one problem with some lawyers if they dont see a big profit for them, they dont want the case . some will tell you its not worth their time and your money ( to them ) to persue it and maybe they are right but Justice needs to be done . the dirtpile will continue overstocking until someone gets killed or seriously injured . find another with less scruples . LOL

i worked for the one in danvers back 12 years ago.. they have good lawyers who specialize in settlements not involving the courts.. definitley persue this.. they have deep pockets and should be more careful..

however their stores are painfully understaffed by people who are not paid enough to really give a sh!t.. all that matters is the bottom line.. i say take some off the bottom line and take care of yourself..
