Nyatt Road Access Victory

In what could be a landmark decision, a judge has ruled in favor of providing public parking at a ROW. Projo Article

great victory! i just hope the MORONS who share our fishing spots don't litter up the place and make a lot of noise at nite! if they do, that place will be closed faster than a speeding bullet! it's right in the middle of multi- million $$ homes and those people are pissed!

Fantastic victory! I fish the barrington area all the time including that spot and one right down the street from there that some old guy living there always give me #^&#^&#^&#^& about parking. Even though the police have told him a million times it is public acces. Lets straghten him out next!..lots of rich folks that will fight like hell to get them out. Please use proper courtesy and pick up your junk and just be a nice guy and we wont have any problems. I think i know who won this victory...he is a nice gentlemen that has fought for years over this. I'll see him at Barrington beach soon and tell him nice job! this is great news:)

Im down there just about every morning this time of year. I drive a black Nissan Xterra. Just look for the 20 something year old guy and thats probably me!

Regardless of whether or not people make noise or litter, the spot should remain open – just as our DEM access areas remain open.

It’s gotten to the point where access is being denied based upon unsupported claims of litter and noise, or simply so a developer can offer real estate as “exclusive.” By the time the word is out that a spot may be lost, we find that it is done deal.

I'm not a lawyer, but my interpretation is that our Constitution provides that our right to the shore remain without caveats. They did not declare that we have a right the shore “only if people are quiet,” or “only if a lot of people do not come.” We have a right to the shore, period.

This is encouraging news. By the way what is the deal with Quonny? There is no public ROW there, is something being done to try and change that.

I agree 100%, but there are two judicial systems in this country one for the rich and one for the rest of us. If that place is surrounded by million dollar homes, those folks are politically connected and will have the access shut down in heartbeat if noise and litter follow the public access.

Does that mean they'll take the no parking signs off ledge road?
I got a ticket there the other day.

Pete_G 08-12-2004 12:40 PM

Be glad all you got is a ticket.

They're more then happy to tow you some nights if you don't have a fishing permit.
