He suffered fatal wounds to his abdomen and genitals. When Garza ran to the foot of the stairs, he took a blast to the left shoulder and staggered out into the street where he bled to death before medical help could arrive.

It was found out later that Resindez was armed with a stolen 45 caliber handgun he took from another home invasion robbery. The victim, 50 year old David Burien, was not so lucky as he died from stab wounds to the chest.

Its a very real issue.

likwid - the owner of the .45 that got stolen was stabbed to death by the perps in a previous home invasion. no way to tell from the article, but what if he DID lock it up and the 2 perps cracked open a safe?

Imagine what kind of damage could have been to her psychie had she not protected herself against two real murderers. You wouldn't want your daughter to do the exact same thing in that case?

I wouldn't exactly call it murder......I think they got what they deserved on that one.

I agree it isn't really good for her mentally but she didn't do anything wrong.

You won't find that kind of justice through the courts folks. I guess they picked the wrong house and the wrong little girl to try to victimize. Like stripersnipr said - good thing her fathers Mossberg wasn't locked up. Here here.

Here is the section of the Montana code. I think the use of the word murder in the above is a little too much. I think whatever scars she may have from this incident will be a lot less than the baggage she would be carrying if she had not shot assumng she lived.

45-3-102. Use of force in defense of person. A person is justified in the use of force or threat to use force against another when and to the extent that he reasonably believes that such conduct is necessary to defend himself or another against such other's imminent use of unlawful force. However, he is justified in the use of force likely to cause death or serious bodily harm only if he reasonably believes that such force is necessary to prevent imminent death or serious bodily harm to himself or another or to prevent the commission of a forcible felony.

Can you imagine if that happened in Mass. ? We would have live reports from the scene of the massacre, with follow-ups about how we need a law so this type of needless bloodshed by 11 year olds can't happen again, then of course there would be the indepth interviews with the scumbags relatives about how they were actually good guys and didn't deserve this.

Good for her, she chose not to be a victim.

Nice shooting Montana Patty!! :) In addition to saving herself , who knows how many others she saved by ending their violent carreers!

I cannot believe some actually object to her defending herself.

As far as her making a bad shot and only hitting the second guy in the shoulder....he did bleed to death. All' s well that ends well! :)

Montana, Wyoming, Nevada, Idaho and some other states out that way are like nothing you have apparently ever had the chance to enjoy. They don't think like a lot of people out here on the eastcoast do. What is right is right and what is wrong is wrong. There is no grey area like there is out here. Political correctness takes a back burner especially when it comes to family. There aren't many "sheeple" out there either...............
