just read about a portugee from Warwick who just got busted in Buzzards Bay with 153 sea bass..... this allstar has 3 prior violations for poaching, holds a commercial license, had 75 fish on board that were below the legal size limit, and didn't bother to get a saltwater fishing permit.....


but I'm sure its all a big misunderstanding.......

Unfortunately with our legal system here, he'll probably get no fine or penalty and will be advised to seek legal action against the EPO for "lost time and wages" because of their "aggressive" tactics.

He should get fine, loss of gear (all of it) permanent barring from getting a fishing license. If he flips on all/any of his buyers, they should be informed that he was the one that ratted them out.

The harbormaster there is right on top of it. This isn't the first dip#^&#^&#^&#^& she bagged, and it won't be the last.

Problem is the judge who hands down the penalties is just a judge, not a waterman or interested party. Their only connection to the incident is handing out a sentence for the facts they are presented with. Then it's on to the next case

Of course some of these "judges" won't consider a repeat offender's priors, unless that is, he/she is being investigated for judicial misconduct or by the media!

With the way things have been going in legal circles, I'm not surprised the judge didn't try to re-write the laws so that this POS would be considered the victim of official harassment?

Or maybe some judges are friends of friends who take a big chunk of cash to make the charges go away.

Are these criminal charges or civil?
Seems in the scope of things going on in the world the judges have other things to worry about ?
Should be a set monetary value to each fish 100 bucks a fish. Just like a speeding ticket the cops have a little book they open up and 35 in a 20, thats blah blah dollars. Out of season, 100 bucks
Short fish, 100 bucks
No license, 100 bucks
So if a guy gets caught with 150 fish over the limit, that's $15,000
Guy has a bass that's an inch short, hundred bucks and so on

The fines would be a good start, but if the POS is raking in that much in a day/week/month then he could take the loss if he's still allowed to go out and do it again somewhere else (usually of a "new" boat).

Plus, what if a fine is levied against him and he just doesn't give a rat's patoot about the law and won't pay it? I this POS is able to get away with this for so long, he's probably got more friends in low places to help him out (of town).
