Threats, suits, jail ???
In Massachusetts the liklihood of this kid going to jail are slim and none, and Slims in Texas.
It is difficult to call pointing pliers today at you a threat that would constitute a crime even though he hit you in some fashion a month ago causing your skin to bruise. If thier was a case pending against him today for the hitting you with the pliers a month ago then pointing the pliers at you would constitute intimidation of a witness, but probably not be considered a threat. They are somewhat one in the same. The threatening to have occurred would have to have been something overt, either a speaking by the punk or a physical action such as moving toward yopu quickly, which generally would be coupled with whatever the punk uttered to you.
An assault occurs when something is set in motion towards you but either stops short or misses. Misdomeanor assault would be someone swinging thier fist at you but missing. Felony assault would be jabbing at you with the sharp pliers and missing.
The illegal touching of another is the definition of assault and battery by any means. Thier is misdomeanor and felony hear also the same as in assault.
Assault and battery by means of a dangerous weapon, which is what happened to you when he hit you with the pliers is what the officer you spoke with at school meant when he said the punk committed a felony. Three weeks or a month after the fact even though it was a felony would not be considered arrestable even though felonys are arrestable after the fact. In other words the felony does not have to be witnessed by the officer. He can take a report of the felony and then go affect an arrest.
Do what Flaptail and JR said. Strength in numbers and fill your parents in completely. If he shows up at your house dial 911. If he bothers you in school find the nearest adult or teacher. Any further problems with him you might want to suggest the new harrassment law that was enacted a few years ago. It might be just what the doctored ordered. Where you are confined to a building for a day with this kid it could be a remedy. Oh and before you ask anyone, do not try to get a restraining order. Since the punk is not family and you never dated you wont get a 209a. A judge though in court could issue a stayaway order, which if he violates could be considered a violation of probation. It takes longer for the probation violation to kick into gear, but its something to keep in mind.
