I'm sure your attorney can give you info. on eminent domain takings but generally it has to be done for a public purpose, can't be done by a private entity and requires that you be paid fair market value as determined by an independent appraisal. I have never heard of a taking of an "item" like a tree, etc. only property. That FMV would have to take into consideration more than just the wood value. Things like cost for replacement, impact on your property, etc. would have to be factored in.
