A lot of the ones we have that we know are extremely dangerous, if tried under US law, will get released in the US as nobody else will take them. On the battlefield a marine doesnt have the time, training or materials to collect evidence and get statements from witnesses. It will be the prisoners word against the marines word, but the marine will be out on his 4th or 5th deployment and unable to testify against him, so he'll walk. We sure as hell can't ferry marines back and forth from Afghanistan to testify in a US court. Without the military courts, these guys will be released after a short jaunt through our judicial system. No evidence, no witnesses and arresting officer is unavailable to testify, perfect recipe for a disaster.
