You appear to be mixing issues.

There are still inmates at GITMO that have been cleared of all terrorism charges, but their home country won't take them, or in the case of China would probably prosecute them. They have discussed releasing some of these prisoners into the US as an option.

I've not seen anyone talking of simply releasing dangerous inmates into the US because of a technicality, nor do I belive for a second this would happen.

The irony is that had Bush actually had any conservative principals we probably wouldn't have this mess in the first place. Either shoot them on the battlefield or follow the rule of International law that we've previously agreed to. The longer we keep GITMO open the longer that eyesore is used to generate sympathy for our real enemies.
