A Senate hearing for a lifetime appointment is not a criminal trial nor should it be.
Confirmation hearings were not intended to be based on the rules of evidence, but on the judgement of Senators, the hundred top ranked elected officials in a coequal branch of government.
It is wiser to err and not confirm than it is to put a person on the Supreme Court for life who, even in appearance, is tainted in some way.
No person is important enough to take that chance.
