So. W. Point

I was there last weekend and I went down the sucky thru the lake to find it closed off with boulders???? Now the entrance is by way of some guys driveway. Is this legal right of way? Did the town change it? On the maps I have it says public beach access

There IS a Legal ROW through the opening in the stone wall. You have to park back up aways but you can legally walk down the trail.

No boat, back in the suds.

That trail looks like someone's driveway. You have to go through an opening in the stone wall and there is a small shack being built right along the road. You sure this is a public ROW?

Public ROW's often go through private property. The landowner doesn't need to make it look inviting, they just can't stop the use...

go ahead and use it, just strangle the guy, if you see him, that leaves all his bird's nests and wrappers there. we've been trying to nab him but he's a stealthy SOB.

Todd:
We have the same problem on the mainland. There is a spot I fish that the kids like to party at and they leave enough aluminum cans to buy a new car.

No boat, back in the suds.

It's amazing how when access is "restricted" out here the garbage makes it just to the point where it would only be a little farther to the vehicle to take it home. I asked one guy this summer why he was leaving it "there" and he said so it would be easier for the cleanup people to find. WTF?

I was there last weekend also.

....what #^&#^&#^&#^&#^&#^& said.

Shouldn't be too bad unless you decide to walk out there at hight tide. in which case, you will be walking, up high, on the bowling ball size rocks...and by the way if you find a mint condition Needle washed up on the shore -it's mine.

You know....legally a ROW doenst have to provide parking, it only has to provide access for people to walk through to the water. This is the great loop hole that will strangle the surfcaster out of many prime spots as more and more neuvo riche folks from out of state move here and stake their waterfront claims

look at tuckermans ~ classic example.

"Cleanup People" that's rich. Why do some horse'sarses think that Mummy is right behind them to pick up? This is the main reason that we're losing access-TRASH!

ROW

In Massachusetts it is encumbent upon the landowner that the ROW travels across to keep the ROW open and passable.
