TD Banknorth Garden WTF?

Stepson who turned 21 last month went to the Celtics game today, and they don't serve beer to someone with a RI issued drivers liscense until you're 25?

Considering these are both goverment issued ID's how can they do this?

MA liqour laws... tricky stuff.. actually illegal to take an out of state ID at all.. have to take risks with that on the cape in the summer...and in venues like that.

I had a similiar yet , slightly different experience.
I have been refused service when I used to use my military id at some mass. establishments.

the ONLY form of ID the ABCC says is acceptable is a MA issued drivers license, or a MA liqour ID... anything else, is at the peril of the establishment.

the classes used to drive me crazy...MA ABCC laws are FUBAR

just bring ur own liq and get a soda.My boss at the country club i worked at in walpole taught me that trick. get a flaskand vuala(or as he would say, "swish")

Mass. is the capital of fake ID's is why Spence. Most of Mass. businesses have or can have a license swipe machine just like a credit card swipe. Pass the license through the swipe and on a small screen appears the info on the license which is either verified as real or phony.

Just to clarify.....

"If a licensee is charged with permitting the service, delivery, or possession of alcoholic beverages by a person under 21 years of age, under current state law, a licensee has a defense only if the licensee can affirmatively prove that prior to permitting the service, delivery or possession of alcoholic beverages by a person, the licensee requested, was shown, examined and reasonably relied on either:

A valid Massachusetts driver license,
A valid Massachusetts Liquor Identification card,
A valid Passport issued by the United States government, or by the government, recognized by the United States government, of a foreign country,
A valid United States issued active duty Military Identification Card.
Reliance by a licensee on any other form of identification to determine proof of age does not give the licensee a defense.

As of September 1, 2001,neither the state Liquor Control Act nor the regulations of the ABCC require identification to be checked as a condition to selling or delivering an alcoholic beverage to any person. Each licensee is left to decide for itself what policy to establish on checking identification prior accepting orders for, selling and delivering alcoholic beverages. Some licensees adopt a conservative policy, as they may legally do under the Liquor Control Act and the ABCC regulations, and require proof of age from any person who appears to be younger than thirty (30) years of age and accept as proof of age only the four (4) pieces of identification that give a licensee a defense to any criminal

Therefore, while a licensee may choose to rely upon any form of identification to obtain proof of age, only these four (4) forms of identification provide a defense to a charge of service, delivery, or possession of alcoholic beverages by a person under 21 years of age."


So what this says is that an establishment can accept any form of ID that it wants to....but if that person they served turns out to be under 21 they have no legal recourse if they accepted any other form of ID but those listed above.

An establishment is also not required to accept those above if they so choose....its strictly up to the establishment what they accept or what there policy is

The fines are huge if you get caught selling to a minor....not only to the business but to the Clerk who eff'ed up as well.

So if my wife sells to a minor and she gets bagged, not only does her boss get fined....she gets popped for a fine as well....something w/ at least 3 zeros at the end...

thats why businesses air on the side of caution.....

and where everyone complains that the EP's are usually nowhere to be found....the ABCC officers are always around, setting up stings and looking to bust a liqour establishment

Should roll the age back to 18 anyway.....

Most college presidents and many police chiefs support it. There is evidence that a lower drinking age would lead to less binge drinking that much of the under 21 age group participates in.

And here's the trip up when considering my opinion; I haven't had a drink in 15 years, and I have 19 yo twins in college.

Had a buddy once who grew up in NYC and didn't even have a driver's license, so he used his US Passport, he used to get denied all the time in Boston bars!!

He finally gave in and just got a Mass liquor ID....
