MA Commercial permit question

I'm not trying to start an argument here just had a couple questions I hoped someone here could help me with.
I understand that the boat permit covers everyone aboard the vessel to catch the fish but who is allowed to sell the fish? Just the boat owner or can another individual catch fish and sell to a dealer without the presence of the boat owner?
Also can a rod and reel permit holder fish commercially from a boat?(I assumed no but just wondering)
And finally, can you recreational fish from a vessel that is registered commercially?

Also can a rod and reel permit holder fish commercially from a boat?(I assumed no but just wondering)Yes, that is what a lot of the commercial rod and reel guys do

And finally, can you recreational fish from a vessel that is registered commercially? I'm gonna float out a guess on this one but I'm pretty sure its fine.

I THINK boat permit $130.oo covers all anglers on board 30 fish limit, but u also need a comm sales permit to sell fish. individual must have own permits to sell fish in there name. u can fish a boat alone with individual permits as well as the shore. last question i think no ...... any help people ??????

This might help on Question 3....

from the DMF regulations

"Vessels permitted as both for-hire vessels and commercial vessels may not engage in commercial fishing activity for groundfish species while engaged in for-hire fishing activities [CMR 7.01]"

which sounds like if a commercial vessel is taking out people to recreationaly fish they can't be Commercial fishing at the same time.....so you can rec fish from a commercially registered boat....just can't do both at the same time

Do you know if I can fish commercially from a vessel that is not under my name with my rod and reel permit?
And I know there is additional safety equipment required for commercial boats in offshore waters, but is there any extra safety regs for inshore?

A striped bass is not a groundfish...so yes you can double dip...as long as the fish are 34" you can have 30 on board and have a charter...you can not groundfish commercially and charter in state waters is all that law reads...as far as the permit goes, the boat is permitted and you can only have one limit per boat per day...it does not matter if you have ten individual licenses on board...Doug

....Also they have it seperated now that if you have a boat license, you can't catch and sell bass from shore, nor can you have a shore permit and fish/ posess 30 fish on a boat. permit is for boat. By the same toekn, you can't have a permit for one boat, but fish in another, ie borrowing your buddy's boat.....of course, that is how it all SUPpOSED to be .........
