Tradmarking / Greed run amok - gee, where have we seen this Monster before?

Weak, I hate &^#$ like this, maybe we need to have S-B Monster Golf Night and support these people (I'm golfin' with the Bombas).

The legal battle over a company’s name has taken a new turn.
Monster Mini Golf in Seekonk is one of 23 franchises nationwide owned by Christine Vitagliano and her husband, who are now fighting for the name “monster” in Monster Mini Golf.
“They don’t want us using the word monster anymore,” says Vitagliano.


Monster Cable Products Inc. of California has taken on dozens of companies who have used “monster” in their names or products. The company challenged the green monster seats at Fenway Park in what critics call a strong-arm approach.


“Monster is not a company that frivolously uses litigation against other businesses. In fact, we consider lawsuits to be a last resort option. Unfortunately, as in the case of Monster Mini Golf, our fair and reasonable offer for the company to continue using our trademark under a license was refused,“ said Daniel Graham, of Monster Cable, in a statement.


In most cases the company works out a settlement or a licensing agreement. In an Internet search, NBC 10 found dozens of companies or products using the word “monster” in their names.
The Vitaglianos said they have already spent $100,000 and that they don’t have a court date.


All of the past settlement cases have included a gag order, but NBC 10 will try to report on any developments in the case.

My favorite all time restaurant in Somers Point NJ, I practically lived there in the 80's was forced to close by a large chain. Man and wife had run the business for 30 years, ChiChi's, I still have my ChiChi's dining card sad sad.

Monster.com should sue Monster golf and be done with it.

The Preservation Society of Newport County has trademarked 'Newport Mansions' and so prohibited any of the others that are not under their umbrella from using that description....

It's already withstood one court challenge...

Um does that mean they can sue Disney for using Monster's INc. ???


Just plain old corporate greed. No one would confuse their products,because they are so danged overpriced.

They did sue Monster and settled out of court.

I think I'm going to copyright the word "The" and if any company uses it on any of there media/marketing materials I will sue the crap out of them

If you're thinking about getting a trademark attorney and filing for a trademark, make sure that you can make a significant amount of profit off your trademarked name because you're going to be writing a lot of checks to the trademark attorney. Its not worth trademarking something that is not going to make you a significant amount of money.

Actually, I already did long ago. The suit against you will include at least 7600 violations looking at your username and posting history. I'm sure when we look into the posts themselves that number will increase substantially.
