Insurance Companies.....

So I go canoeing with the Boy Scouts this past weekend on Friday. They need another truck to haul the gear so I say no Problem, thats why I got it.

We pull into a McDonalds parking lot because we notice that one of the canoes is loose. I park next to the Scoutmaster's truck and he climbs up on the bed of my truck to tie it down tighter. Looks good and tight now, He says to me "Are you ready" I say "Yep lets go"

I open My Door and Hop in the truck and before I Can close my door he takes off......and Catches my door with the canoe trailer and almost Rips it off the truck.

Now we both started parked with the cars off, he hops in and drives away because he's in a hurry AND he admits he didn't even look in the Mirror when he pulled out......yet the Insurance Company says the Accident is MY FAULT....WTF Because my Door was open.

So now I guess I can just go around and clip doors at my hearts Content because it will always be the other guys fault.


I HATE Insurance Comanies.....I've been driving for 25 years and this is the 1st time I ever put in a claim....and I get hosed

Thats nuts. Hows that different than hitting a parked car?
So, if a 5 year old opens a door and it gets clipped, its the 5yr olds fault? I thought the law puts the ownership on the moving vehicle. That really sucks, I would fight it if you can.

There are exceptions to every rule . . . If you and the "Scoutmaster" stipulate that he was at fault the insurance companies will deem him at fault and you can collect 100% of the damages from his carrier (or your carrier will subrogate whatever they pay to you) - including the deductible which you will not be responsible for nor will you be assessed points for purposes of SDIP (where the real money is at!).

Insurance companies are your friend . . . ya just gotta take some time to understand 'em is all . . .

I think your ins. companies subrogation dept is supposed to handle 'who's what % at fault' types of claims. My guess is they're just looking for the easy way out.
They have no problem taking your money but paying it out is another ball game.

you'll never win. it is your fault.
just like opening the door into traffic.

i've heard there's a rule somewhear that says your not even supposed to get out that side of the car
