Given the fact that this stuff was in a bunch of other cities for weeks before this , without any uproar, is going to make a pretty good case that the city of Boston and state of MA simply overreacted, and the people behind this are not guilty of anything and not responsible for any damages. If 9 other cities didn't panis before they put the things up in Boston, would it be "reasonable" to assume that the authorities in Boston would panic?

I think there's also an issue with intent. I don't think anyone believes there was any any intent to harm or even scare. The only crime I can see is some kind of misdemeanor for posting on public property. Blatant stupidity isn't a felony yet.

TITLE I. CRIMES AND PUNISHMENTS


CHAPTER 266. CRIMES AGAINST PROPERTY


Chapter 266: Section 102A1/2. Possession, transportation, use or placement of hoax devices; penalty; law enforcement or public safety officer exemption


Section 102A1/2. (a) Whoever possesses, transports, uses or places or causes another to knowingly or unknowingly possess, transport, use or place any hoax device or hoax substance with the intent to cause anxiety, unrest, fear or personal discomfort to any person or group of persons shall be punished by imprisonment in a house of correction for not more than two and one-half years or by imprisonment in the state prison for not more than five years or by a fine of not more than $5,000, or by both such fine and imprisonment.

(b) For the purposes of this section, the term “hoax device” shall mean any device that would cause a person reasonably to believe that such device is an infernal machine. For the purposes of this section, the term “infernal machine” shall mean any device for endangering life or doing unusual damage to property, or both, by fire or explosion, whether or not contrived to ignite or explode automatically. For the purposes of this section, the words “hoax substance” shall mean any substance that would cause a person reasonably to believe that such substance is a harmful chemical or biological agent, a poison, a harmful radioactive substance or any other substance for causing serious bodily injury, endangering life or doing unusual damage to property, or both.

(c) This section shall not apply to any law enforcement or public safety officer acting in the lawful discharge of official duties.

(d) The court shall, after a conviction, conduct a hearing to ascertain the extent of costs incurred, damages and financial loss suffered by local, county or state public safety agencies and the amount of property damage caused as a result of the violation of this section. A person found guilty of violating this section shall, in all cases, upon conviction, in addition to any other punishment, be ordered to make restitution to the local, county or state government for any costs incurred, damages and financial loss sustained as a result of the commission of the offense. Restitution shall be imposed in addition to incarceration or fine; however, the court shall consider the defendant’s present and future ability to pay in its determinations regarding a fine. In determining the amount, time and method of payment of restitution, the court shall consider the financial resources of the defendant and the burden restitution will impose on the defendant.

I wish we could all be as smart as Likwid. then it would be clear to us all that objects placed under bridges are obviously part of some marketing campaign and we should never think that they could possibly be dangerous.

that is too effin funny. i spent a lot of time in Chinatown in Boston this weekend.

i have to say, i think the Chinese food in Boston is the best on the east coast, might even rival Vancouver. Boston is definitely better than NYC, hands down.

No doubt there may have been some degree of over reaction but to think a Cop is going to consult his children when an unidentified object is found attached to a bridge is a little out there. What percentage of our population has even heard of this cartoon, let alone were aware of this marketing campaign? Do a Google search on "unknown object attached to bridge" and see what you come up with.

I thought the war in Iraqs purpose was to make the citizens of American feel more secure about there safety. Clearly we are more scared then ever of terrorism and this is a perfect example. The war in Iraq has done nothing but made this country extremely paranoid of a terrorist attack.

and I'm sorry but any electronic device placed on a bridge abutment that wasn't placed there by a City/State Worker should raise a flag, No matter WTF it looks like.

Stripersniper - You really feel that we are winning the war on terror? The terrorists have been at war with us forever, we should always be on a alert, it should not take thousands of people dieing to figure out that they are trying to kill us. But striking fear into the hearts of every American is not the way to beat terrorism, quite the opposite.

The rest of the world that deals with terrorism continues on.
There's bombings CONSTANTLY in Israel but you don't see them freaking out over everything and anything.

Maybe those other cities didn't have unpaid people placing those things on bridges, maybe those other cities had sense enough to not do that WTF I bet they put them in more unsuspecting places.... duh

From what I've heard about the LA placements, they're not much different, and they're just as unpaid everywhere as here.

Zounds. Crazy new concept! Street teams! People who put up concert posters/all kinds of other strange promo things/etc. even when the dead were around (but i think those street teams were handing out shrooms maaaaan shrooms and loooooove)! They had STREET TEAMS! waa waa wee wow!

For all of Bush's faults and there are MANY, we haven't had a terrorist attack since 9/11.

The threat of this kind of crap is conceivable and if something like this happens again I hope the city follows the same procedure. You folks complaining about yesterday would feel very different if one of your loved ones was a causalty of terrorism. Whats to say, the next lite brite type thing in an oddball spot doesn't detonate something?

Mabye aging and having kids has softened me up, but I still get the sick in your stomach feeling thinking of the families affected by the 9/11 attacks. People were just going to work.
