Resindez was the first to get up to the second floor only to be the first to catch a near point blank blast of buck shot from the 11 year olds knee crouch aim. He suffered fatal wounds to his abdomen and genitals. When Garza ran to the foot of the stairs, he took a blast to the left shoulder and staggered out into the street where he bled to death before medical help could arrive.

It was found out later that Resindez was armed with a stolen 45 caliber handgun he took from another home invasion robbery. The victim, 50 year old David Burien, was not so lucky as he died from stab wounds to the chest.

Its a very real issue.
How many accidents are there every year between kids playing with guns and other general accidents?

likwid - the owner of the .45 that got stolen was stabbed to death by the perps in a previous home invasion. no way to tell from the article, but what if he DID lock it up and the 2 perps cracked open a safe?

i don't disagree with you at all on proper storage.

Imagine what kind of damage could have been to her psychie had she not protected herself against two real murderers. You wouldn't want your daughter to do the exact same thing in that case?

I wouldn't exactly call it murder......I think they got what they deserved on that one.

I agree it isn't really good for her mentally but she didn't do anything wrong.

You won't find that kind of justice through the courts folks. I guess they picked the wrong house and the wrong little girl to try to victimize. Like stripersnipr said - good thing her fathers Mossberg wasn't locked up. Here here.

Here is the section of the Montana code. I think the use of the word murder in the above is a little too much. I think whatever scars she may have from this incident will be a lot less than the baggage she would be carrying if she had not shot assumng she lived.

45-3-102. Use of force in defense of person. A person is justified in the use of force or threat to use force against another when and to the extent that he reasonably believes that such conduct is necessary to defend himself or another against such other's imminent use of unlawful force. Can you imagine if that happened in Mass. ? We would have live reports from the scene of the massacre, with follow-ups about how we need a law so this type of needless bloodshed by 11 year olds can't happen again, then of course there would be the indepth interviews with the scumbags relatives about how they were actually good guys and didn't deserve this.

Good for her, she chose not to be a victim.

I cannot believe some actually object to her defending herself.

They don't think like a lot of people out here on the eastcoast do. What is right is right and what is wrong is wrong. There is no grey area like there is out here. Political correctness takes a back burner especially when it comes to family. There aren't many "sheeple" out there either...............
