My bro gets all the guys paperwork and goes to write the complaint. Well he decides to run the guy for the hell of it. It turns out the guy has 3 warrants out for him. I just asked my brother and father. Both said under those circumstances that is not possible. As far as questioning a minor with out parental permission is also against the law . sounds like your son is being railroaded . they have any witness that saw him take money and checks out of the wallet before he made it to the police station ? there is something fishy here . I am pretty sure that if they came to see your son at the house, and someone invited them in anything in plain view would be considered a legal search and siezure. B&E's ......and i'm like ....WHAT?!!! and WTF are you talkin bout willis..... just incredulous.... so then: i'm informed that my car had been seen in several homes driveways that were broken into and neighbors had copied down the license plate...ect. on and on it went , with -> having to agree to a search of my home or face more severe penalties for any contraband found other than the stolen items of interest..... pfffffffff i had lived on west island at the time...and remembered always seeing these two SUITS in a VW hatchback sitting near the causeway..... watchin everyone go by....they were detectives workin my case..... eventually: i started comparing DATA to my schedual and found out that the burglaries occurred on the day i left my vw bug at a front end shop in dartmouth to be fixed and i didnt reclaim it until the next day.... it was the front end mechanics(crooks) access to my vehicle and the keys ..... i shoulda sued the front end shop. it just demonstrates the madness that goes ON :af: fishaholic18 03-13-2005, 09:20 AM Originally posted by MAC Dave, did you try talking to the Chief? Present it in a positive light for your son - and show people it is the right thing to do. And lawyer up is not an option, IMHO. And for your kids and all kids. I have found a wallet and dumped it in a mailbox as well. I would suggest that, if anyone finds a wallet, drop it in the closest mailbox. I also wouldn't handle it much. Getting finger prints inside the wallet could be evidence that could be used against you. One night a couple of years ago I am awakened by a very loud pounding on the front door at 3:30 A.M. I get up to answer and find two cops there. Having come from a law enforcement family, having nothing hide and being appreciative of the job they do I immediately invite them in out of the cold. They ask me if I realize the interior light was on in my car. I responded no, but I probably left it on when I came home that night. One of them asked if I would go check the car to make sure everything was in order and a break-in was not attempted. I complied and went out to check assuming the two of them were behind me. I found everything in order and then realized one of them stayed in the house. No big deal, I and the the officer that went outside with me returned back inside. The officer who stayed behind was no where in sight. I asked officer one where his partner was and he stated "probably looking around". I walked in the living room and found officer two rummaging through an ashtray on the coffee table. At this point I'm feeling that this just isnt right. I asked "what the hell do you think your doing?" Response "just looking around". My response "for what"? answer "Whatever I can find". I then thanked them for their concern and informed them their services were no longer required and please get the hell out of my house now. Thats when officer one requests my name, social security number and date of birth. I see no choice but to comply and give him that information. Not good enough, "Show us ID". I start to go in the bedroom to get my wallet when I'm told to "stop to right there we will go with you". I lost it at this point and said BS you are I'm calling my lawyer and went for the phone. At this point the two of them went outside (presumably running me for warrants). They sat in the driveway for a full half hour with me standing on the front porch glaring at them before they left. The next morning, 9:00 A.M. I'm at the station to speak to the chief who is too busy to see me. I tell my story to the officer at the desk who assures he will inform the chief. Two days go by and I receive a letter form the chief thanking me for my concern and stating his boys were "just doing their job". I know if I heard this story my initial thought would be that this guy must have a history, be a person of interest, etc. etc. Not. I truly beleive this is how these clowns treat everyone and I will never support any policy or law that increases police power in this state. There is obviously some information that the police have re: the wallet and missing $$. Somebody probably reported seeing a kid pick it up and walk off with it. The suspects probably took the $ and checks and dropped it. Then your son comes along and turns it in. probably the same height, weight and age of the perp. So the cops think they have at the minimum a possible suspect. As far as the cops in your home, as long as they were let in by someone of age who has a property interest in the home and is able to consent to allowing them in, their presence is ok. Then anything in "plain view" can be inspected for their safety, or obvious contraband. (ie. your wife lets them in to chat about the wallet and they see a pound of pot on the kitchen table....or a knife with blood on the t.v) I would obviously object to them going through personal papers of yours on the table if an issue ever arose there. You should get a criminal defense attorney, or at least consult with somebody if the police aren't giving you any answers. Forgive me if my 4th Amendment skills are lacking, I do mostly real estate now. Im sure that you would win in court without a lawyer but this issue needs to be heard a little bit more than just this website. It sets a nasty precedent for our youth, it is encouraging them to not be honest upstanding members of society.
