Mike, is it difficult to obtain permission to keep herring penned up. The reason I ask is in Falmouth your permit to obtain herring is included with your Shellfish permit. There is languange in the material they provide that you must seek and be granted permission from the Shellfish Warden in order to pen herring (presumably any amount over the 20 per open day you are allowed to possess). Ever have any experience with this issue . . . I understand your situation as a shop owner may be different than a "civilian"

The town has no say on how many herring you can have. There are many legal ways of taking them & not just limited by permit. The town can regulate you putting a pen on a mooring permitted by the town, they do not have a say in marinas, which you pay for a slip unless specifically mentioned in their permits to operate. And we found out that we needed a permit by the coast Guard to put one in a River like the Weweantic (possible navigational hazard), which is almost never given.
If they do have any regulations in the town you wise to put one go over their head and get a propagators permit issued by the state only cost $10.
