I don't want to be afraid but people suck. I used to always feel safe where I fish. Thanks for the critter advise Raven. I see lots of coyotes but they usually take off. I worry about coming up on one and surprising it. I actually had a stare down with a coyote once. I don't know who was more scared. He came out of nowhere on a black night sniffing around my rods. He was 3 feet away from me. Shined my light on him and he just stood there. staring. It was a pup and I am guessing that since I was on the refuge he had never seen a person before. I got tired of staring at him and told him to git. Ha ha he got.
Those nights when it's dark and you smell skunk are a long slow walk to the parking lot. I am going to look into pepper spray for the human predators.

I say if you guys carry shoot to kill, justified homicide !
On a side note,
One day last summer I was in the Sportsman's Den in quincy.
Ronnie (the owner) was helping an older woman (I'm guessing in her mid 60s) with a device that rapid loads her clip, don't remember the size gun .38 maybe.
I thought that was AWESOME !
Would love to be there and see some thug try to purse snatch this nice old lady and end up getting their f^^^ing head blown off !

You gonna go to court to see her sentencing hearing too...
Justifiable Homicide is when your life is threatened.....not your purse.
I know its cool to get all "Clint Eastwood" about it.....but you better make damn sure that you have absolutely no other recourse to save your life before you pull the trigger....that includes walking away from a situation instead of escalating it...or you'll end up being Bubba's Butt Buddy or the next 20 to life.
Not saying the dirtbag purse snatcher doesn't deserve it......but is it really worth it for a fishing rod, or a plug bag.

Great point. If you shoot and kill an unarmed person (especially one with no violent criminal history), it's gonna be tough to justify self defense. Spending years in jail away from your family would be much worse than losing some fishing gear.
Even if you were able to stay out of jail, would you be able to live knowing that you took someone else's life over some replaceable stuff?

To me its not right the way the MA shooting criteria leaves all the burden on the person being attacked in the first place. In MA you need to stand on your head and do everything possible to try to run away etc when despite you minding your own business someone comes along who is willing to do violence to steal your property. Will he kill you? How do you know?
This is an absolutely true stury. I have a friend from Peterborough , NH who was held up at gun point on the main drag through Peterborough. The guy demanded his wallet. He took out his wallet and handed it to the guy. The guy shot him point blank in the stomach and walked away. Just shot him for the hell of it despite my friend readily handing over the wallet. Now I am far from bloodthirsty but I think the use of a gun should extend to protecting your property too.
I was approached once at a very remote spot at the canal by a guy in street cloths (not waders etc) who had to worm his way through 25 feet of brush to get to where I was. He stands still hidden in the bushes and asks me , "are you alone"? Not how's the fishing or are they biting , etc. "Are you alone". Fortunately I was actually fishing with Tim and Charlie from SOL and they started yelling at me like what was I doing talking to the bushes. As soon as this guy saw I was not alone , he turned and ran away.
Now I did not see a gun on him but there is no doubt in my mind that he was packing. From that day forward I started fishing much more public areas along the canal and seldom alone anymore.
Now for the most part , you either are a damned fool to approach a guy who spends his spare fun time standing on rocks on the waters edge all night with the intent to rob him unless... you are armed.
Anyway , that's my rant on the subject.

You really think someone in their mid to late 60s or older and goes around with a legally permitteed loaded gun is worried about jail.

Maybe it would be worth going to jail if they gave you conjugal visits.

Ditto, the punks were running through Bourne Scenic stealing coolers with beers in them, swilling them down and acting like idiots. Breaking glass on the access road and stuff. Someone has to actually turn up as a victim here for me to believe some of the innuendo and rumors.
And as far as OC Spray goes, FID card at the most. A new law a couple of years ago made the cost $25.00 for a pepper spray only license, renewable for free the next time around for the rest of your life.

For thirty seven years I told people the same as above, "when a crook robs you he is going to have his weapon already drawn and pointing at you." In response if your carrying a weapon and try to draw on the crook, the crook is going to put six in you before your weapon clears the holster." And in fact if the crook hits you with the first round, you'll will collapse to the ground in shock even if the round didn't hit you on one of the numbers.
We have this same thread every year. First rule of survival is flight. If you dont consider flight first then any jury or judge might conclude that whatever combat that took place was mutual in some respects. At your home/castle no flight is necessary, but anywhere else.....................just saying

Not everyone can simply run for it....
some are unable to do so because of limmited mobility
(ie handicapped or can't run...must stand and fight)
how would a judge and Jury look at that scenario?
as i don't see it as mutual... then.

The "duty to retreat" outside of the home has one important exception----you must be able to retreat "with complete safety". If a guy has you backed against a wall, you're surrounded by a gang, or your mobility is handicapped, there is then no duty to retreat.
You're also not expected to be able to outrun a bullet.

I've often wondered if a full swing of my 11'er to the face would hurt enough to put a normal (not PCP'ed up tweaker) person down. Might get lucky with a brachial Stun..

As far as the "with complete safety" on the retreat goes... what do you suppose the scenario is if you are on the bubble weed covered rocks of the canal at low tide... by the time i found my footing up the canal to run, i could be dead six times. Maybe more depending how fast they can reload.

The bottom line is, self-defense comes down to a question of fact for the judge or jury. All aspects of it. And Barnstable County is still a place where the average juror would be more inclined to side with the respectable citizen, with a clean record, over a guy with a record as long as the canal who approached a fisherman minding his own business. Regardless of the nuances of the law, and the instructions from the judge, jury nullification happens, and it happens most often in cases where punk confronts citizen, and citizen lays out punk.
The other thing to keep in mind on the Canal is this---you'd be dealing with the Bourne or Sandwich PD, and they also would be more inclined to side with you over a well-known local POS. You have to get charged first, to be prosecuted.

My point was about dealing with unarmed people trying to take your stuff from you. If they're armed, I agree with doing what you have to do.
BTW, I've seen that rod you fish at the canal. If you can keep them at rods length, you'll have no issues with them getting close enough to you to do anything
