I use to run a Mass. fully insured, insurance plan for a small insurance company. Our actuary use to file requests for quarterly rate increases. Mass. had a 90 day deemer law meaning if we didn't hear back from the dept., the rates were "deemed" approved. On about the 89 day, we would hear they were reviewing the rates and get an additional 90 days. Frequently, the dept. actuary who was assigned to us was doing special projects and would ignore our filings. We finally left the state. When we notified the state of our intent to leave (and cancel all policies on the renewal date), the woman insurance commisioner called our pres. to ask us to stay but refused to commit to timely actuarial review. We decilined.
