Everyone else addressed the "it's a private business so they get to do what they want." Just like anything else, if you don't like a company's policies then I'm sure they'd be the first to tell you to take your business elsewhere...
However, I have to point out issue with the above statement. People like to support their arguments by pointing to isolated cases that support their position. Let's remember that exceptions don't make the rule.
Hell, I remember reading about a recent study that said smokers and overweight people actually have the potential to save insurance companies money because they die so much earlier than non-smokers.
I'm not saying don't smoke, being that I enjoy a cigar here and there. But I also know I'm not doing my health any favors.
